Abstract
Purpose: This study aims to analyze the operational status of the Korean-style contact tracing system operated based on the Infectious Disease Prevention Act during the COVID-19 pandemic, and to deeply analyze the issues raised in the process that infringe upon individuals' right to privacy and right to self-determination of personal information. In doing so, it seeks improvement measures and policy suggestions to harmonize the public interest of infectious disease prevention with the constitutional value of protecting individuals' fundamental rights. Method: Through literature research and legal analysis, we review relevant laws and the principle of prohibition of excessiveness. We also collect cases of privacy and personality rights violations related to the disclosure of movement routes, empirically elucidate the severity of the problem, and propose improvement measures. Result: The Korean system achieved rapid quarantine results through the government's extensive and state-led collection of sensitive information, including location information and credit card details. However, the absence of legal controls, such as the warrant system, poses a potential infringement on the right to self-determination of personal information. Institutional and technical improvements, such as strengthening the principle of legal reservation and introducing judicial controls, are necessary. Conclusion: It is suggested that the scope of information collection should be clarified by strengthening the principle of reservation of interest, a post-hoc court approval and judicial control device should be introduced for the location information collection process, and in the long term, a Bluetooth-based tracking system that guarantees individual anonymity should be explored to establish a quarantine system that balances public health and the protection of fundamental rights.
연구목적: 본 연구는 코로나19 팬데믹 기간 한국형 감염자 접촉 추적 시스템의 운영 실태와 개인의 프라이버시권 및 개인정보자기결정권 침해 문제점을 분석하여 , 감염병 확산 방지라는 공익과 개인의 기본권 보호라는 헌법적 가치를 조화시키기 위한 개선 방안 및 정책적 제언을 모색하는 것을 목적으로 한다. 연구방법: 문헌 연구와 법규 분석을 통해 관련 법률 및 과잉금지 원칙을 검토하고, 동선 공개 관련 프라이버시 및 인격권 침해 사례를 수집하여 문제의 심각성을 실증적으로 규명하고 개선방안을 제안한다. 연구결과: 한국형 시스템은 위치정보, 신용카드 내역 등 민감 정보를 국가 주도적으로 광범위하게 수집하여 신속한 방역 성과를 거두었으나 , 영장주의 등 법적 통제가 부재하여 개인정보자기결정권 침해할 소지를 내포하였다. 법률유보 원칙 강화, 사법적 통제 도입 등 제도적·기술적 보완이 필요하다. 결론: 법률유보 원칙을 강화하여 정보 수집 범위를 명확히 하고 , 위치정보 수집 절차에 사후적 법원 허가 사법적 통제 장치를 도입해야 하며, 장기적으로는 개인의 익명성을 보장하는 블루투스 기반 추적 시스템 도입을 모색하여 , 공중 보건과 기본권 보호의 균형을 이루는 방역 체계를 구축해야 한다고 제언한다.
