Abstract
Purpose and Method: The government is promoting institutional efforts such as revision of various legal systems to reduce continuous accidents. However, the number of deaths in the construction industry remains at the level of 400 per year. Although alternatives are proposed at various levels, concrete discussions and empirical studies on which areas should be improved have not been conducted. In this study, we intend to examine the trends of legislation related to serious accidents in the construction industry, analyze the current status and problems through a DB related to construction accidents, and propose improvement measures. Results: The accident rate in the construction industry has not decreased significantly, and legal ambiguity and problems in field application are constantly being raised. Conclusion: It is necessary to integrate the definition between laws, and smart technology, and it is necessary to establish safety management system using effective safety education and technology using smart technology and smart technology.
연구목적과 방법: 정부는 끊이지 않고 발생하는 사고를 감소시키기 위해 다양한 법제도의 개정 등 제도적 노력을 추진하고 있다. 그러나 건설업 사망자 수는 여전히 연간 400여명 수준에 머물러 있다. 다양한 차원에서 대안을 제시하고 있으나 구체적인 논의와 실제 현장에서 어떤 부분이 현실성이 떨어지고 개선되어져야 하는지에 대한 실증적인 연구는 이루어지지 못하고 있다. 본 연구에서는 건설업 중대재해 관련 법제 동향을 살펴보고 건설사고 관련 DB를 통해 현황 및 문제점을 분석하고 개선책을 제안하고자 한다. 연구결과: 건설업의 재해 발생률이 크게 감소하지 않았으며, 법적 모호성과 현장 적용상의 문제점이 지속적으로 제기되고 있다. 결론: 법령 간 정의를 통합하고, 기업 규모별 차등 적용을 도입하며, 실효성 있는 안전교육 및 기술적 장치를 활용한 안전관리 체계를 구축하는 것이 필요하다.
